POSITION POTENTIAL: The top grade of this position is GS-13. TEMPORARY PROMOTION . Applicants should be aware that the temporary promotion may be terminated at any time at the discretion of management. If management terminates the temporary promotion, the individual selected will be returned to the technician position and salary held prior to the temporary promotion. Management may extend ! the temporary promotion. Management may make this temporary pr! omotion permanent with no additional competition. There is no guarantee that this temporary promotion will be made permanent. KEY REQUIREMENTS

The purp ose of this position is to serve as the full - time professional l egal advisor and support to the Adjutant General, the Commander of federally recognized Army and Air National Guards, and state/territory unique public defense or safety structures. Also serve s as the principle professional legal advisor to the United States Property and Fiscal Officer (USPFO), state/territory National Guard senior leadership, state/territory National Guard d irectorates, and subordinate National Guard commanded units or state/t erritory level divisions. Acts as a l egal a dvisor and a ttorney for the state/territory National Guard , responsible for the formulation of state/territory legal policy and its execution legal representation; le! gal initi atives; interpretation and litigation of U.S. and state/territory (s) c onstitutional, c ivil, c riminal, l abor l aw ; i nternational l aw and t reaty a greements; t rial d efense ; and a full spectrum of expert legal advice. Responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack there of, instruments associated with emerging o r highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural di sasters. Serves as an attorney/advisor providing acquisition and fiscal legal advice to the state/territory' s assigned United States Property & Fiscal Officer (the Chief of the National Guard Bureau's agent in the state/territory ) and act! ive duty m ilitary a dvisors. Advises Army National Guard ( ARNG ) and ! Air National Gu ard ( ANG ) contracting officers, reviews contracts, procurement actions and real property matters involving Federal and state/territory funds (some involving substantial amounts of money) for legal sufficiency, appropriate titling and claim initiation or re solution actions. QUALIFICATIONS REQUIRED:

BASIC QUALIFICATION REQUIREMENTS : The basic qualification requirements are indicated below. These qualification requirements must be met, in addition to any military requirements, in order to be found qualified for and selected to this position.

MINIMUN REQUIREMENTS: A law degree (LLB or J.D) from a law school accredited by the American Bar Association, Bar Membership and an active member in good standing of a state, territory of the United States , District of Columbia , or Commonwealth of Puerto Rico Bar.

SPECIALIZED EXPERIENCE : (Please prepare written justification to the following KSAs as an attachment to you! r resume/application) :

1. Ability to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack there of, instruments associated with emerging o r highly conflicted and emotionally charged issues such as intelligence oversight related to Homeland Security, or advising on Federal and state/territory Executive Orders for the use of federalized troops in response to domestic emergencies and natural di sasters.

2. Ability to advise appointed and elected le aders on the appropriate use of National Guard personnel, resources and status issues for critical and diverse missions, emergency responses, contingencies and exercises, ensuring execution is consistent legislative intent, executive orders, current U.S. C odes and state/territory l aws, c ourt decisions and agreements.

3. Ability to serve as an attorney/advisor providi! ng acquisition and fiscal legal advice to the state/territory's assigne! d United States Property & Fiscal Officer (the Chief of the National Guard Bureau's agent in the state/territory ) and active duty m ilitary a dvisors.

4. Ability to provide advice and legal assistance in bid protest matters and represents the National Guard in disputes before fiscal and contract administrative and judicial forums.

5. Ability to prepare litigation reports, unfair labor practice charges, petitions for injunc tive relief, and supporting legal documents.

QUALITY AND TYPE OF EXPERIENCE : The required amount of experience/education will not in itself be accepted as proof of qualification. The quality, type and scope of the experience/education must be of such nature as to demonstrate that applicants are fully qualified to perform the duties at the level for which they apply.

DOCUMENTATION : Applicants must explain in detail, in the application, how the specialized experience was acquired, including applicable dat! es. Applicants should include, with application, any training completion certificates/transcripts in the areas covered in the KSAs.

MILITARY COMPATIBILITY : Individual selected must be assigned, prior to appointment, to a compatible Duty Military Occupational Specialty Code of: Branch: 27A.

APPOINTMENT REQUIREMENTS : Excepted Civil Service. Individual selected must be assigned to a commissioned officer position in the New Mexico Army National Guard. Individual must wear the uniform as prescribed by National Guard Bureau policies and the Adjutant General of New Mexico. Employment is contingent upon the successful completion of a pre placement physical examination. HOW YOU WILL BE EVALUATED:
